PRIVACY ACT AUSTRALIA

In compliance with the Privacy Amendment (Private Sector) Act 2000, we have developed a Practice Privacy Policy that governs the handling of your personal information. Personal Information means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent or can reasonably be ascertained, from the information or opinion (P57 Guidelines on Privacy in the Private Health Sector, Office of the Federal Privacy Commissioner – October 2001). The Federal Privacy Act incorporates the Australian Privacy Principles (APPs) that set out the rules for the handling of personal information in the private health sector. In the interests of providing quality health care this practice has implemented a privacy policy that complies with the Privacy Act (1988) and the APPs (2014).

COLLECTION OF INFORMATION  

It is necessary for us to collect personal information from clients/patients and sometimes others associated with their health care (such as next of kin or guardian) in order to attend to their health needs and for associated administrative purposes. When registering on our site, when you subscribe to our newsletter, when you fill out a form in person at the clinic, as appropriate, you will be asked to enter your name, email address, mailing address, phone number or other details to help you with your experience.

HOW DO WE USE THIS INFORMATION

A client’s/patient’s personal health information is used or disclosed for purposes directly related to their health care and in ways that are consistent with the client’s/patient’s expectations. 

YOUR EMAIL ADDRESS IS USED TO:

  • Send information, confirm appointments, respond to enquiries, and/or other request or questions
  • Market to our mailing list or continue to send emails to our client’s/patient’s with their consent after the original transaction has occurred – they can unsubscribe at any time.

In the interest of the highest quality and continued care this may include continued sharing of information with other health care providers with the client’s/patient’s consent, who comprise of the client’s/patient’s health care team. This may include GP’s, allied health professional or support staff. Client’s/patient’s health and personal information will not be used for any other purposes without their consent. In circumstances when information has to be disclosed without client’s/patient’s consent, they may include:

  • Disclosure of information to fulfil a medical insurance obligation/s
  • Emergency health situations such as calling 000 
  • Information to private health funds if relevant for billing and medical rebate purposes
  • Disclosure of information to fulfil programs such as Workcover Qld. 
  • There are also necessary purposes of collection for which information will be used beyond providing health care, such as professional accreditation, quality assessments, clinical auditing, billing, service monitoring activities, improving the administration of the practice and disclosure to a clinical supervisor.
  • The individual’s privacy is protected by federal privacy legislation and state privacy legislation. This practice does not send data / information to locations outside of Australia.

HOW DO WE STORE YOUR INFORMATION

It is necessary for the practice to keep client’s/patient’s information after a client’s/patient’s last attendance for as long as is required by law (7 years or until a minor turns 25 years) or is prudent having regard to administrative requirements. The storage, use, and where necessary, transfer of personal health information will be undertaken in a secure manner that protects client’s/patient’s privacy.
  • We do not use vulnerability scanning and/or scanning to PCI standards
  • We only provide articles and information
  • We do not ask for credit card numbers
  • We use safe electronic database storage
  • We use regular malware scanning
  • We do not specifically market to children under the age of 13 years old – parents are in control of information given to us. 

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your personal information.

All card transactions are processed through a HICAPS eftpos terminal provider and are not stored or processed on our servers.

ACCESS & CORRECTION OF YOUR INFORMATION 

Tanya Keam Wellness encourages client’s/patient’s to ensure that information held is accurate and up to date and to amend any information that is inaccurate such as phone numbers and next of kin in the case of emergency. Clients/patients may request access to their personal health information held by this practice or its transfer to another health provider. All requests for access to personal health information will need to be made in writing. The Tanya Keam Wellness Director will review and manage the request. Personal health information will not be shared via email or post with other health providers. Printed copies of treatment notes and other health information will be printed by Tanya Keam Wellness within 14 days of request where the client’s/patient’s can personally retrieve from the place of practice. A charge may be payable by the client’s/patient’s where the practice incurs a cost in providing access. This is for administrative costs such as photocopying, printing etc.

This practice acknowledges the right of children and young people to privacy of their health information. It might be necessary at times to restrict access to personal health information by parents or guardians depending on current Australian law.

ANY CONCERNS
Tanya Keam Wellness recognises the right of client’s/patient’s to raise their concerns about privacy and confidentiality. Client’s/patient’s are asked to contact us if they have any concerns regarding the collection, use or disclosure of the personal health information. The best way to deal effectively with concerns and complaints is to communicate openly and respectfully by phone, email or in person. We will endeavour to acknowledge your complaint within two working days of receiving it. Where possible, a response to your complaint will be provided to you within 14 days of the date we acknowledge your complaint. Where this is not possible, due to the complexity of your complaint or other factors, we will keep you informed.

  • Endeavour to protect your email in our software and not share your email information with third parties

  • To communicate with parent/guardian about any concerns regarding the health and safety of a child under 13 years of age and adhere to appropriate consent regarding protection of their privacy 
Dealing with your concerns
  • Communicate openly and respectfully
  • Endeavour to acknowledge your complaint within 2 working days of receiving it
  • Where possible, a response to your complaint will be provided to you within 14 days of the date we acknowledged your complaint
